These Terms and Conditions ("Terms") govern your access to and use of the website located at cjslegacy.com (the "Site") and any programs, services, or activities offered by CJ's Legacy Ranch / ELTS Foundation ("we," "our," or "us"). By accessing the Site or participating in any of our programs, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Site and do not enroll in our programs.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law provisions. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Denton County, Texas.
1. Use of the Site
You agree to use this Site only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use and enjoyment of the Site. You must not use the Site to transmit any unsolicited or unauthorized advertising, promotional material, or spam; attempt to gain unauthorized access to any part of the Site; or engage in any conduct that is harmful, fraudulent, or deceptive.
We reserve the right to terminate or restrict your access to the Site at any time, without notice, for conduct that we believe violates these Terms or is otherwise harmful to us, other users, or third parties.
2. Intellectual Property
All content on this Site — including but not limited to text, photographs, videos, graphics, logos, and design elements — is the property of CJ's Legacy Ranch / ELTS Foundation or its content suppliers and is protected by United States and international copyright and trademark laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from this Site without our prior written permission.
3. Program Enrollment and Fees
Enrollment
Submission of an inquiry or registration form on this Site does not constitute a confirmed enrollment. Enrollment is confirmed only upon receipt of written confirmation from CJ's Legacy Ranch / ELTS Foundation staff and, where applicable, receipt of any required fees or deposits.
Fees and Payment
All fees for lessons, boarding, camps, and other programs are due as specified at the time of enrollment. We reserve the right to modify our fees at any time with reasonable advance notice.
Refund and Cancellation Policy
All reservation deposits and boarding reserves are non-refundable. Cancellation policies for individual programs (lessons, camps, therapeutic riding) will be communicated at the time of enrollment. We reserve the right to cancel or reschedule any program due to weather, safety concerns, or other circumstances beyond our control, and will make reasonable efforts to offer alternative scheduling.
4. Assumption of Risk and Release of Liability
Equestrian activities involve inherent risks of injury, including serious injury or death, that cannot be eliminated regardless of the care taken. By participating in any program or activity at CJ's Legacy Ranch / ELTS Foundation, you (and, if applicable, as parent or legal guardian on behalf of a minor participant) voluntarily assume all risks associated with equestrian activities, including but not limited to falls, kicks, bites, and unpredictable animal behavior.
To the fullest extent permitted by applicable law, including the Texas Equine Activity Liability Act, Tex. Civ. Prac. & Rem. Code § 87.001 et seq., you agree to release, indemnify, and hold harmless CJ's Legacy Ranch / ELTS Foundation, its officers, directors, employees, volunteers, agents, and representatives from any and all claims, damages, losses, costs, or expenses (including reasonable attorney's fees) arising out of or related to your participation in any equestrian activity or program at the ranch.
This release does not apply to claims arising from our gross negligence or willful misconduct. Separate written release and waiver forms may be required prior to participation in specific programs.
5. Health and Safety Requirements
All participants must follow the safety rules and instructions of CJ's Legacy Ranch / ELTS Foundation staff at all times. We reserve the right to remove any participant from a program or activity at any time if, in our sole judgment, their behavior poses a safety risk to themselves, other participants, staff, or animals. No refunds will be issued for removal due to safety violations.
Participants with known medical conditions, physical limitations, or disabilities that may affect their ability to safely participate in equestrian activities are responsible for disclosing this information to our staff prior to participation. We will make reasonable accommodations consistent with applicable law, including the Americans with Disabilities Act.
6. Minor Participants
Parents and legal guardians are responsible for ensuring that minor participants comply with all program rules and safety requirements. By enrolling a minor in any program, the parent or legal guardian represents that they have the legal authority to do so and agrees to these Terms on behalf of the minor. All waivers, releases, and consent forms must be signed by a parent or legal guardian for participants under the age of 18.
7. Photography and Media Consent
By participating in our programs, you grant CJ's Legacy Ranch / ELTS Foundation a non-exclusive, royalty-free license to photograph, video record, and otherwise capture your image and likeness (and, if applicable, that of your minor child) during program activities, and to use such images and recordings for promotional, educational, and marketing purposes, including on our website and social media channels. If you do not consent to this use, please notify us in writing prior to participation.
8. Boarding Terms
Horses boarded at CJ's Legacy Ranch / ELTS Foundation are accepted subject to a separate boarding agreement that will be provided at the time of enrollment. Boarding fees are due monthly in advance. We reserve the right to place a lien on any boarded horse for unpaid fees in accordance with the Texas Agister's Lien, Tex. Prop. Code § 70.001 et seq.CJ's Legacy Ranch / ELTS Foundation exercises reasonable care in the management of boarded horses but is not liable for illness, injury, or death of a horse resulting from causes beyond our reasonable control, including but not limited to acts of God, communicable disease, or the horse's own behavior.
9. Disclaimer of Warranties
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CJ'S LEGACY RANCH / ELTS FOUNDATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PARTICIPATION IN OUR PROGRAMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify, defend, and hold harmless CJ's Legacy Ranch / ELTS Foundation and its officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorney's fees) arising out of or relating to your violation of these Terms or your use of the Site.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without giving effect to any choice-of-law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Denton County, Texas, and you hereby consent to personal jurisdiction and venue in those courts.
In the event of any dispute, the parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, the parties agree to mediation before pursuing litigation.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with a revised effective date. Your continued use of the Site following the posting of changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
